Acceptance of Terms

By using ewynk.com or engaging our services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please refrain from using our website or services.

Services We Provide

eWynk offers software development, website optimization, automation, consulting, analytics, and related digital solutions ("Services"). Our scope of work, timelines, and pricing are defined in project proposals, statements of work (SOW), or agreements shared before project initiation.

Client Responsibilities

• Provide timely access to project information, assets, and approvals.
• Review and respond to deliverables within agreed timeframes.
• Ensure that any materials shared (logos, data, content, etc.) are owned or licensed for use.

eWynk is not responsible for project delays caused by lack of client response or dependencies.

Payments and Billing

• All invoices are payable as per the agreed schedule (usually 50% upfront and 50% on delivery, unless stated otherwise).
• Payments are non-refundable once development or consulting work begins.
• Late payments may result in project delays or suspension.
• Taxes and transaction fees, if applicable, are the client's responsibility.

Intellectual Property Rights

• Upon full payment, all final deliverables (code, designs, documents) developed under a project belong to the client.
• eWynk retains the right to showcase non-confidential work in its portfolio for marketing purposes.
• Any third-party tools, APIs, or frameworks used remain the property of their respective owners.

Confidentiality

Both parties agree to keep all project-related information confidential and not share it with third parties without written consent, except as required by law.

Revisions and Change Requests

Each project includes a fixed number of revisions (defined in the proposal).

Any new features or major scope changes beyond the original agreement will be billed separately after approval.

eWynk reserves the right to adjust delivery timelines accordingly.

Limitations of Liability

• eWynk is not liable for indirect, incidental, or consequential damages, including data loss, business interruption, or profit loss.
• We are not responsible for performance issues caused by third-party services, plugins, or hosting providers.
• Total liability, in any case, shall not exceed the total amount paid by the client for that specific project.

Warranties and Support

• All projects include a limited support period post-launch (typically 15–30 days).
• Ongoing maintenance or feature updates can be covered under a separate retainer agreement.
• We ensure best-effort quality assurance but do not guarantee uninterrupted operation due to external dependencies.

Termination

Either party may terminate the project with written notice if the other party:

• Breaches these Terms or project agreements, or
• Fails to make payments or provide required materials within a reasonable time.

All work completed up to the termination date must be paid in full.

Third-Party Services

We may integrate or recommend third-party platforms (e.g., Shopify, Supabase, Google Analytics). We are not responsible for their performance, security, or terms of use.

Users should review third-party policies separately.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh.

Changes to Terms

We may update these Terms from time to time to reflect changes in our operations or applicable laws. The latest version will always be posted on our website with a revised “Last Updated” date.
